e are delighted to see that our web site has grown tremendously in the last few years. With this growth, comes a number of challenges and opportunities about how our site is used by individual patients, members of the medical community and the medical industry.

In order to ensure that visitors to our site enjoy their time with us, it is now necessary to implement some rules about how our web site, and the information it contains, is to be used. We have modeled these rules on those established by leading and well known web sites.

PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS SITE.

By using this site, you signify your agreement to these terms and conditions of use. We reserve the right to modify them at any time. Please review these terms and conditions periodically for changes. By using this site after we have posted changes to these terms and conditions, you agree to accept those changes, whether or not you have reviewed them. If you do not agree to all of these Terms and Conditions, do not use this site.


Scope of Terms and Conditions

These terms and conditions apply to your use of all of the sites and services owned or operated by Synechion, Inc. (“Synechion”), or the International Adhesions Society (IAS) and any other site that we have owned or operated, do own and operate or may own or operate in the future (collectively, the "Sites"). Unless stated otherwise, all references to the Sites in these terms and conditions include all such sites. Of course these terms and conditions do not apply to your use of unaffiliated sites to which any of the Sites only links.


THE SITE DOES NOT PROVIDE MEDICAL OR OTHER PERSONAL ADVICE.

The contents of the Sites, (including but not limited to information contained on message boards, in text, in text files, in chats, graphics, images, information obtained from our licensors, and other material ("Content") contained on the Sites) are for informational purposes only. The Content is not intended to be a substitute for professional advice in any field, including, but not limited to financial, medical, or legal matters. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a physical or mental medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on the Sites!

If you think you may have a medical emergency, call your doctor or 911 immediately. We do not recommend or endorse any specific tests, products, procedures, opinions, or other information that may be mentioned on the Site. Reliance on any information provided by Synechion, the IAS or their employees, agents, representatives, volunteers or others appearing on the Sites at our invitation, or other visitors to the Sites is solely at your own risk.

The Site may contain health or medical-related materials which you find sexually explicit or otherwise offensive. We, our licensors, and suppliers have no control over and accept no responsibility for such materials. You are solely responsible for compliance with the laws applicable to your country of residence.

We and our licensors or suppliers make no representations or warranties concerning any treatment, action, or application of medication or preparation by any person following the information offered or provided within or through the Sites. Neither we, nor our partners, or any of their affiliates, will be liable for any direct, indirect, consequential, special, exemplary or other damages that may result, including but not limited to economic loss, injury, illness or death.

Restrictions on Use of Materials

The contents of our Sites are protected by copyright and trademark laws, and are the property of their owners. Unless we say otherwise, you may access the materials located within the Sites only for your personal and non-commercial use. This means you may download one copy of posted materials on a single computer for personal, noncommercial home use only, so long as you neither change nor delete any author attribution, trademark, legend or copyright notice. When you download copyrighted material you do not obtain any ownership rights in that material. You must not use the IAS logo, or name unless it is with our permission.

You may not modify, copy, publish, display, transmit, adapt or in any way exploit the content of the Sites. Only if you obtain prior written consent from us -- and from all other entities with an interest in the relevant intellectual property -- may you publish, display or exploit any material from the Sites. By way of illustration and not limitation, this includes the use of email addresses posted in our message board, volunteer listings, adhesions quilt or other place for the purposes of soliciting for or developing your own private or commercial product, service or project. Although individual information posted on our Site by its visitors may still belong to an individual, any collective aggregate of information posted is considered by us to be protected under copyright laws. Accordingly, you may not attempt to circumvent us by contacting the originators of such postings in order to reconstruct any part of the aggregated information.

If you violate any of these Terms and Conditions, your permission to use the Content automatically terminates and you must immediately destroy any copies you have made of any portion of the Content.


Links

These terms and conditions apply only to the Sites, and not to the sites of any other companies or organizations, including those to which any of the Sites may link. We are not responsible for the availability of any other site to which any of the Sites links. We do not endorse or take responsibility for the contents, advertising, products or other materials made available through any other site. Under no circumstances will we be held responsible or liable, directly or indirectly, for any loss or damage that is caused or alleged to have been caused to you in connection with your use of, or reliance on, any content, goods or services available on the Sites, or on any other site. You should direct any concerns to that site's administrator or webmaster. These sites and services may have their own privacy policies and customer service policies, or no policy (policies) at all. We encourage you to review the privacy policies of any third party sites or services before providing any of them with your personal information.

A Word to Medical Companies, Drug Companies and Suppliers, and Medical Professionals

We appreciate your visiting our site and hope that we have provided you with useful information about adhesions. We are very much interested in presenting information about products or services that will benefit our visitors. We therefore ask that you contact us to discuss advertising and sponsorship opportunities as well using some of the content from our site for your commercial purposes.

Unfortunately there have been a number of cases of abuse of not only the content of our site, but also of exploitation of our visitors. In most cases it seems that the perpetrators have been well-meaning but over-zealous sales people trying to promote products by sending messages to email addresses harvested from our site. In other cases, patients have been offered sums of money to help promote products or services (money that was in some cases never paid as promised).

In still other instances, companies have deliberately attempted to circumvent the IAS for their own purposes. However well-meaning (or not), we must point out to you that these activities are highly unethical, and in some cases illegal. If this site has value to you, then we ask that you recognize it by offering your financial support so that we may continue to help the thousands of visitors that we see every month.

A Word to Patients who are contacted directly by Medical Companies, Drug Companies and Suppliers, and Medical Professionals

In this regard (see previous section), if you are contacted by anyone with a product or service to sell, PLEASE report this to us immediately. Please make sure you get as many details as possible (name of person, name of company, contact address and phone number, date, content of communication etc.). Please forward any emails or printed materials to us. It goes without saying that you should exercise extreme caution in disclosing to anyone any personal details.


Submissions

We welcome your comments and suggestions about any of the Sites and their projects, either by email or by posting somewhere on our Sites. However, we will not review or consider any unsolicited creative submissions. We hope you will understand that this policy is intended to avoid the possibility of future misunderstandings in the event that projects developed by us might seem to others to be similar to their own creative work. Accordingly, we must ask that you not send us any original creative ideas or materials. If, despite our request, you send us any creative idea or material ("Submission"), it shall become our property. No Submission will be subject to any obligation of confidence by us, and we will not be liable for any use or disclosure of any Submission. We will exclusively own all known or later-existing rights to the Submission worldwide, and will be entitled to the unrestricted use of the Submission for any purpose, without compensation to the provider of the Submission.

You agree that you will not upload or transmit any communications or content of any type that infringe or violate any rights of any party. By submitting communications or content to any part of this Site, you agree that such submission is non-confidential for all purposes. If you make any such upload or transmission, you automatically grant--or warrant that the owner of such content has expressly granted—Synechion, Inc., a royalty-free, perpetual, irrevocable, world-wide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, and display the communication or content in any media or medium, or any form, format, or forum now known or hereafter developed. Synechion, Inc. may sublicense its rights through multiple tiers of sublicenses.


Forums

A "forum" means any message board, chat room, user review forum or other interactive service appearing on any of the Sites and includes both public boards and private folders. You must register in accordance with instructions that you will find on the Sites in order to contribute to any forum.

If you use a forum, you are solely responsible for your own communications, the consequences of posting those communications, and your reliance on any communications found in the Public Areas. We are not responsible for the consequences of any communications in the Public Areas. In cases where you feel threatened or believe someone else is in danger, you should contact your local law enforcement agency immediately. If you think you may have a medical emergency, please call your doctor or 911 immediately.

In consideration of being allowed to use forums or Sites in general, you agree you will have materially breached these Terms and Conditions if:

  1. You use the Sites or forums for any purpose in violation of local, state, national, or international laws;
  2. You post material that infringes on the intellectual or other property rights of others (this means that you must have copyright ownership of all material that you post on our Sites. No articles, recipes, song lyrics, art or graphics may be posted without the express written consent of the copyright holder.
  3. You post material that infringes on the privacy or publicity rights of others; (this means the posting of someone’s phone numbers, addresses, social security numbers or any other private information
  4. You post or send to any other forum user or our employee material that is unlawful, obscene, vulgar, defamatory, threatening, harassing, abusive, slanderous, libelous, defamatory, hateful, racist, or embarrassing to any other person or entity as determined by us at our sole discretion;
  5. You post material known to be false.
  6. You use the Sites for commercial purposes, by soliciting for business; or advertising goods or services;
  7. You post solicitations for funds. Unfortunately, it is impossible to verify the validity of each and every organization that solicits donations; therefore in an effort to protect our visitors from fraud we must prohibit solicitations for charities.
  8. You use a forum to promote another web site. One time posts to links where information useful to our visitors is acceptable, but repeated postings containing references, solicitations or links to other sites (including their subsidiary pages) is not permitted. Postings of this nature made by owners of other sites or their agents will be deemed to have granted us a perpetual royalty-free and worldwide license to any or all of the content of that site.
  9. After receiving a warning, you continue to disrupt the normal flow of dialogue, or post comments that are not related to the topic being discussed (unless it is clear the discussion is free-form);
  10. You post chain letters, pyramid schemes or stock touts;
  11. You impersonate another person;
  12. You distribute viruses or other harmful computer code;
  13. You harvest or otherwise collect information about others, including email addresses, without their consent;
  14. You allow any other person or entity to use your identification for posting or viewing comments;
  15. You post the same note more than once or "spamming"; or
  16. You engage in any other conduct that restricts or inhibits any other person from using or enjoying the forum of the Sites, or which, in our judgment, exposes us or any of our customers or suppliers to any liability or detriment of any type.
  17. If you have an idea for a project that will be benefit to our visitors and is consisted with the objectives of our web site, please contact us before posting it on the site.
  18. You participate at your own risk on the Sites, its forums and email. You take responsibility for postings under your identification and use the information provided here at your own risk. We take no responsibility for the content or opinions posted here.

We reserve the right (but are not obligated) to do any or all of the following:

  1. Record the dialogue in public chat rooms.
  2. Investigate an allegation that a communication(s) do(es) not conform to the terms of this section and determine in its sole discretion to remove or request the removal of the communication(s).
  3. Remove communications which are abusive, illegal, or disruptive, or that otherwise fail to conform to theseTerms and Conditions.
  4. Terminate a user's access to any or all forums and/or the Sites upon any breach of these Terms and Conditions.
  5. Monitor, edit, or disclose any communication in the forums.
  6. Edit or delete any communication(s) posted on the Sites, regardless of whether such communication(s) violate these standards.
  7. Notify law enforcement officials regarding any postings that may be construed as stalking

We reserve the right to take any action it deems necessary to protect the personal safety of our guests or the public. We have no liability or responsibility to users of the Sites or any other person or entity for performance or nonperformance of the aforementioned activities.

We are not responsible for material appearing in any forum on the Sites, except for material signed by one of our identified representatives. We are not responsible for screening material posted by users for libel, obscenity, invasion of privacy, copyright or trademark infringement, accuracy, or for any other reason. We retain, however, the right to modify or remove messages or other material that we, in our sole discretion, consider infringing, offensive, abusive, defamatory, obscene, stale, or otherwise unacceptable.

We also reserve the right to edit materials for any other reason. Whether or not we modify or remove such material, users remain solely responsible for the content of their messages or postings.

By posting on the Sites, you grant (or warrant that the owner of such rights has expressly granted) us and/or relevant affiliated companies the worldwide, perpetual, nonexclusive right to use your questions, comments, and postings, in their original or edited form, in television programs, books, articles, commentaries, or in any other medium now known or later developed. You also warrant that you own or otherwise control all of the rights to the content you have posted and that the public posting and use of such content by us will not infringe the rights of any third party. Additionally, you warrant that any "moral rights" in posted materials have been waived.

You are not entitled to any compensation for any materials you may post on the Sites.

Although individual information posted on our Site by its visitors may still belong to an individual, any collective aggregate of information posted is considered by us to be protected under copyright laws.

We may, at our discretion, suspend or terminate the registration of any forum user who violates any of these terms and conditions of use, any of the member guidelines or for any other behavior that we in our discretion believe is inappropriate.

All Questions and Answers to the Forum should be presented in a medical, supportive, and/or personal life experience format.

The Sites are not places for JOKES. Humorous or funny personal anecdotes relevant to the topic of the post are not JOKES and are fine, but canned jokes DO NOT belong on the Sites. Please remember, what is funny to one person might be offensive to another.

Please do not use the words Help, Worried, Urgent, etc. in Subject Line. Each post is important to each of the senders and those words only encourage EVERY post to begin with Urgent, thus defeating the purpose of trying to get an answer. A far more effective method is to state the nature of your post in the subject heading.

Please remember, the Sites ARE NOT Debating Forums; so therefore we must insist that people with a strong difference of opinion do not slam, flame, bait, insinuate, or "name/names" in postings. We are all entitled to our own and different opinions. The Sites are not places for Debate on treatments, personal lifestyle decisions, or moral or religious judgments.

Sharing information about products or services is encouraged. Commercial mass sales and marketing posts are not acceptable.

Copyright Complaints

JURISDICTION

We control and operate this site from our offices in the United States of America. We do not represent that materials on the site are appropriate or available for use in other locations. Persons who choose to access this site from other locations do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable.

These terms will be governed by and construed in accordance with the laws of the State of Texas, without regard to any principles of conflicts of law. Any legal action regarding this agreement will take place in the City of Dallas, Texas. You agree that breach of these terms and conditions may cause us extensive, immediate and irreparable damages, and we reserve the right to seek immediate injunctive relief. If any of these terms and conditions is found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms and conditions, and will not affect the validity and enforceability of the remaining provisions. This is the entire agreement between you and us relating to the subject matter it contains. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

INDEMNITY.

You agree to defend, indemnify, and hold Synechion or the IAS, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms and Conditions.

GENERAL.

Synechion and the IAS are based in Dallas, Texas, in the United States of America. We make no claims that the Content is appropriate or may be downloaded outside of the United States. Access to the Content may not be legal by certain persons or in certain countries. If you access the Sites from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. The following provisions survive the expiration or termination of these Terms and Conditions for any reason whatsoever: Liability, User Submissions, Indemnity, Jurisdiction, and Complete Agreement.

We reserve the right to charge fees, surcharges and/or membership fees for all or any of its services currently provided for free at any time upon thirty (30) days' prior written notice to you.

COMPLETE AGREEMENT.

Except as expressly provided in a particular "legal notice" on the Sites, these Terms and Conditions constitute the entire agreement between you and Synechion and the IAS with respect to the use of the Sites and it’s Content. Your use of the Sites is also subject to our Privacy Policy (see next section).
