I take it from your message that you live in Great Britain. I'm not familiar with your lawsuit procedures, but I understand they are more restrictive than in the US, with the loser having to pay court costs. If you lost the suit you would be in worse shape than you are now.

I don't think you have much of a case. Adhesions are a common postoperative complication. The appendectomy surgeon might have minimized their chance of recurrence by the use of an adhesion barrier, but that would depend upon when you had the surgery. My surgeon began using adhesion barriers just within the last year. Adhesion barriers, whether membrane or gel form, only promise up to 60% prevention. You may be one of the 40%. You should check with the gel maker to see if they offer some sort of warranty.

Doctors should also use adhesion prevention protocols such as suctioning up all blood clots and using powder free gloves to prevent leaving things for adhesions to form around. You might have a case if the doctor did not observe these protocols.

If you are going to have to pay out of your own pocket you might want to consider going to a specialist, possibly even abroad. It might even be cheaper in another country depending upon exchange rates. There is a Dr. Reich in New York City that several people on this message board have gone to and reported excellent results with. They could fill you in further on him. One of our group is currently in Germany undergoing laproscopic adhesyiolysis, which includes gel application and a second look laproscopy about a week after the first to remove any new adhesions while they are still soft and filmy and easy to remove. She reports excellent results.

As for legal advice, you should consult a solicitor or barrister for that.
